Donation Terms and Conditions

  1. DEFINITIONS
    1. American Friends of The Ocean Cleanup (“AFTOC”) is a non-profit non-stock Delaware
      corporation and public charity under the U.S Internal Revenue Code sections 170(c)(2)(b)
      and 501(c)(3) respectively..
    2. Goal: AFTOC is committed to preserving and protecting the natural ocean environment for
      the benefit of the public including (i) promoting, developing and performing the
      environmentally friendly, large-scale and efficient extraction of waste from oceans, seas,
      rivers and other waterways; and (ii) promoting, developing and performing the
      environmentally friendly recycling of such waste.
    3. Donation: any asset, including any monetary amount, donated by a Donor, by means of electronic authorization through the website of AFTOC or otherwise.
    4. Donor: a natural or legal person who donates, has donated or will donate a Donation to
      AFTOC.
  2. APPLICABILITY
    1. These Terms and Conditions apply to every Donation. By making a Donation, the Donor agrees to be bound to these Terms and Conditions.
    2. AFTOC uses the personal data of each Donor to process its Donation. AFTOC will not share
      this personal data with third parties beyond what is set out in the Privacy and Cookie Notice
      on the website and in compliance with applicable laws.
  3. DONATIONS
    1. By making a Donation, a Donor agrees that AFTOC can use such Donation domestically or
      internationally, at its own discretion, but only within the scope of the Goal. Donations may be
      transferred in full or in part to other foundations, institutions, and/or other third parties,
      domestically or internationally, to the extent AFTOC has reasonably assured itself, that such
      Donations will be used within the scope of the Goal. A portion of the Donations will be used
      for administrative costs.
    2. A Donation is irrevocable.
    3. Recurring monthly donations can be cancelled upon request by the Donor, by contacting
      us through our website contact form.
    4. AFTOC will provide a Donor with a donation confirmation for single donations of at least
      $250. For Donations under $250, a donation confirmation will be made available upon
      request, by contacting us though our website contact form.
    5. Donations to AFTOC are tax-deductible to the fullest extent allowed by law in the United States. For other
      countries, please check with your local tax adviser regarding tax deductions of charitable
      contributions to AFTOC.
  4. FINAL PROVISION
    1. AFTOC reserves the right to amend these Terms and Conditions at any time.
    2. DISCLAIMER: The ratios of impact included on the website are an approximation based on
      the total donations received and the total waste collected by Stichting The Ocean Cleanup, a
      foundation established in the Netherlands within the 12-month period of 2024. The data on
      the total waste collected by Stichting The Ocean Cleanup and its operations is still being
      verified and is subject to change.
    3. All disputes and controversies arising out of or relating to a Donation(s), these Terms and
      Conditions, or the relationship between Donor and AFTOC shall be fully and finally resolved
      under the Commercial Arbitration Rules of the American Arbitration Association in front of a
      sole arbitrator. The place of arbitration shall be New York, New York. The language of the
      arbitration shall be English.
    4. New York law applies to a Donation(s) and these Terms and Conditions, and governs the
      relationship between a Donor(s) and AFTOC.
