Donation Terms and Conditions

  1. DEFINITIONS
    1. Donation: any asset, including any monetary amount, gifted by a Donor to The Ocean Cleanup North Pacific Foundation (“TOCNPF”), by means of electronic authorization through the website of TOCNPF or otherwise.
    2. Donor: a natural or legal person who donates, has donated or will donate a Donation to TOCNPF.
    3. Goal: TOCNPF is committed to promoting and supporting the development of technologies for the removal of plastic pollution from the seas and oceans.
    4. TOCNPF: The Ocean Cleanup North Pacific Foundation, a non-profit non-stock Delaware corporation and a public charity under section 170(c)(2)(b) and section 501(c)(3) of the U.S. Internal Revenue Code, and is registered to do business in California.
  2. APPLICABILITY
    1. These General Terms and Conditions apply to every Donation.
    2. By making a Donation, the Donor agrees with these General Terms and Conditions.
    3. TOCNPF uses the personal data of each Donor to process its Donation. The Privacy and Cookie Notice on the website applies to the processing of this personal data by TOCNPF.
  3. DONATIONS
    1. By making a Donation, a Donor agrees that TOCNPF and any and all (future) subsidiaries and/or affiliates of TOCNPF are entitled to use a Donation at their own discretion, within the scope of the Goal and the articles of association of TOCNPF.
    2. Additionally, a Donor acknowledges that, within the scope of the Goal and the articles of association of TOCNPF, TOCNPF may further contribute the proceeds from Donations to other entities, and such entities may use such amounts at their own discretion.
    3. A Donation is irrevocable.
    4. Recurring donations can be cancelled upon request by the Donor, by contacting us through our website.
    5. TOCNPF will provide a Donor with a donation confirmation for donations exceeding $250 and to any Donor donating less than $250 upon request by the Donor.
    6. TOCNPF is qualified under U.S. Internal Revenue Code section 501(c)(3). Donations to TOCNPF are tax-deductible to the fullest extent allowed by law in the United States. For other countries, please check with your local tax adviser regarding tax deductions of charitable contributions to TOCNPF.
  4. FINAL PROVISIONS
    1. Any appropriate state or federal district court located in the City and County of San Francisco, California shall have exclusive jurisdiction to judge all disputes or controversies which arise between TOCNPF and a Donor concerning a Donation or these General Terms and Conditions.
    2. California law applies to a Donation and these General Terms and Conditions.
